Natural Resources Canada (NRCan) is undertaking an Indigenous Consultation & Cooperation exercise on a package of proposed legislative changes. The proposals have been organized into three categories to help participants understand the changes being considered and focus on the areas most relevant to them.

What we are asking about

Depending on the proposal, questions may ask whether our preliminary assessment reflects the potential impacts on Indigenous Peoples, whether there are additional impacts or rights-related considerations, what risks or mitigation measures should be considered, and what should be taken into account during implementation.

What happens after the consultation

NRCan will review the feedback received and use it to inform next steps. Information about the results of the consultation, including any public summary or “What We Heard” material, will be added when available.

    This category contains example legislative proposals related to energy security, system resilience and continuity. The final version should explain each applicable Act or authority, the issue the amendment is intended to address, and any preliminary assessment of potential impacts on Indigenous Peoples.

    You can comment on one or more proposals in this category. You do not need to answer questions about every proposal. Select the items that are relevant to you, then provide as much or as little detail as you wish.

    Proposal 1: Emergency energy coordination

    What is currently in place: Existing authorities provide defined tools for responding to specified energy supply or system circumstances.

    Proposed change: The proposal would clarify or update how certain authorities may be used when energy security or continuity is at risk.

    Why it is being considered: The change is being considered to improve readiness, coordination and clarity in circumstances that may affect energy supply or reliability.

    Preliminary consideration for Indigenous Peoples: NRCan is considering whether the proposal could have different effects across regions and communities, including Indigenous communities that rely on particular energy systems, infrastructure or supply arrangements.

    Proposal 2: Information and reliability provisions

    What is currently in place: Existing provisions establish certain information, reporting or coordination requirements related to the energy system.

    Proposed change: The proposal would update those requirements to support timely information and more effective coordination.

    Why it is being considered: The change is being considered to support informed decisions and strengthen energy system resilience.

    Preliminary consideration for Indigenous Peoples: Potential considerations may include data governance, confidentiality, regional capacity, infrastructure dependencies, emergency planning and impacts on rights or interests.

    Proposal 1: Modernized terminology and process

    What is currently in place: The Act uses terminology and administrative processes developed under an earlier legislative or program context.

    Proposed change: The proposal would update selected terms, references or processes to improve clarity and consistency.

    Why it is being considered: The change is being considered to remove outdated references and make the legislation easier to administer and understand.

    Preliminary consideration for Indigenous Peoples: NRCan is considering whether wording or process changes could have substantive or unintended effects on Indigenous Peoples, rights holders, agreements, participation or access.

    Proposal 2: Reporting and administrative updates

    What is currently in place: Existing provisions prescribe specific administrative or reporting steps.

    Proposed change: The proposal would streamline or clarify selected requirements while maintaining core accountability objectives.

    Why it is being considered: The change is being considered to reduce unnecessary administrative complexity and improve consistency with current federal practices.

    Preliminary consideration for Indigenous Peoples: Potential considerations may include transparency, access to information, consultation expectations, implementation capacity and any effects on existing relationships or commitments.
