Natural Resources Canada is seeking comments regarding proposed regulations under the Canadian Energy Regulator Act (CERA).

The Designated Officer Regulations would specify technical and administrative functions to be carried out by designated officers within the Canadian Energy Regulator – employees of the Regulator with expertise in their field.

A discussion paper will be published on Let’s Talk NRCan’s website outlining the approach to these regulations. A survey on the same website seeks your thoughts on the proposal, and your submission will inform the development of the regulations. The comment period will be from December 17th, 2025, to January 30th, 2026.

Proposed approach

The new regulations propose to delegate powers, duties or functions that are technical or administrative in nature to designated officers. Designated officer decisions will not involve broader public interest considerations.

The DO regulations will specify:

  1. Which powers, duties and functions of the Commission are technical or administrative, and

  1. Circumstances in which only designated officers will do these tasks.

  1. Any necessary procedures and practices that apply to the exercise of those powers and the performance of those duties and functions by designated officers.
